1. Eligibility

3. Services and Scope
We offer shared hosting, reseller hosting, VPS, domain registration, SSL certificates, email hosting, and add-on services. Service availability, performance, and limitations are defined in product-specific descriptions and may change without prior notice. You agree not to resell or sublicense the Services unless explicitly allowed by your plan.
4. Acceptable Use
You agree to use our Services in accordance with our Acceptable Use Policy, which prohibits activities such as:
- Sending unsolicited bulk messages (spam)
- Hosting or distributing malware or pirated content
- Engaging in denial-of-service attacks or unauthorized access
- Violating applicable local, state, national, or international laws
5. Payments, Billing & Renewals
- Services are billed in advance for the selected billing term (monthly, quarterly, yearly).
- Auto-renewal is enabled by default. You may disable it at any time via your client portal.
- Late payments may result in service suspension after [X] days and termination after [Y] days.
- Fees are non-refundable unless stated in our Refund Policy.
6. Cancellations
You may cancel your Services through the client area at any time. Cancellation requests must be submitted before the renewal date to avoid further billing. Data will be permanently deleted after termination.

You are responsible for maintaining your own backups. We may provide automated backups for certain plans, but we do not guarantee backup availability or integrity. We are not liable for data loss resulting from server failure, account suspension, or user actions.
8. Resource Limits
Each hosting plan has specific CPU, memory, storage, email, and bandwidth limits. Exceeding these may result in temporary throttling, account suspension, or a recommendation to upgrade your plan.
9. Suspension and Termination
We may suspend or terminate your account for:
- Acceptable Use Policy violations
- Non-payment
- Security threats (e.g., malware, abuse complaints)
- Legal compliance (e.g., court orders, DMCA)
We reserve the right to retain or delete account data upon termination.
10. Intellectual Property
You retain all rights to your uploaded content. We retain all rights to our website, software, infrastructure, and branding. You may not reverse-engineer, modify, or resell our platform without written permission.
11. Service Availability
We strive to maintain 99.9% uptime. However, we do not guarantee uninterrupted access due to scheduled maintenance, system upgrades, DDoS attacks, or force majeure events.
12. Limitation of Liability
To the maximum extent permitted by law:
- We shall not be liable for indirect, incidental, special, or consequential damages.
- Our total liability shall not exceed the amount paid by you for the Services in the last three (3) months.
13. Indemnification
You agree to indemnify and hold harmless Petal Host, its employees, affiliates, and vendors from any claims or damages resulting from your use of the Services or your violation of these Terms or applicable laws.
14. Modifications to Terms
We may update these Terms at any time. Updates take effect upon posting. Continued use of our Services constitutes acceptance of the revised Terms.
